US startups with non residents

Hi,
We are 3 people planning a startup in US with VC funding. One of them is a citizen, one on GC and the other one is on H1B. I understand that a H1B can own a business in US. My questions are:
1. Can the new company have his H1B transferred and he can be on the rolls of the new company and draw a salary?? Please note that the company will be formed new.
Suggestions are welcome.
