INTENT TO TRADEMARK

I would like to sell t-shirts and bumper stickers which need to be trademaked. I am afraid of getting ripped off. Would it be smarter for me to file an Intent to Trademark prior to selling my shirts as opposed to selling my shirts first and then filing for a trademark?

You can file an intent to use a tybe B. I beleive you have to plan to use in commerce within 6 months..Have you the product already? Sold 1? Then you can file a use.

Trademarks can be had by just using them.  Registered TM is a different story.

What specifically are you looking to trademark?  If in fact it does make sense to register your trademark at the federal level, filing an intent-to-use application typically makes more sense since the registration date will map to this date.
