infringement retail product......

A question concerning product / packaging infringement. If a retail product appears similar to another currently on the market is this considered infringement? No original artwork at stake here. Just a simple 2 component product in a simple plastic box. Example: A bar of soap in a unique color and shape in a plastic box. But......with a different scent.

Thanks for your input. The product is so simple it doesn`t have a logo. The competition packages in an acetate box with a paper insert in the bottom reflecting their company name as well as their product name. That`s it.
Still thinking...... A logo could help differentiate the product although it would have to be very small since 90% of the packaging is clear acetate box.
